Conditions
This agreement applies to your customer relationship with our service På(fyll). It describes our and your responsibilities in this regard, so that you can have the best shopping experience possible.
1. General
Påfyllsystemer AS (org.nr. 928 602 346, Torggata 8, 0181 Oslo) operates the service at (fyll) and is owned by Orkla Home & Personal Care AS (org.nr. 911 161 230), Æra Strategic Innovation (org.nr. 922 322 015) and Bakken & Bæck (org.nr. 997 201 280).
We will report attempted fraud to the police. Påfyllsystemer AS reserves the right to cancel purchases if there is a suspicion of fraud. In order to be a customer of our service, you must be over 18 years of age.
2. Prices
All prices you see in our webshop are stated in Norwegian kroner and include VAT (25%). We reserve the right to make any pricing errors and price adjustments.
If you have found an offer or promotion, this is valid as long as we have the item in stock and within the time period specified in the campaign information.
3. Order Confirmation
In order to shop on www.pafyll.com www.pafyll.com you must agree to our terms of sale described in this contract, which constitute the binding agreement between you as a customer and Påfyllsystemer AS.
When we receive your order, you will receive a confirmation to your registered email address. This order confirmation also serves as a guarantee certificate after completion of payment.
Once you have placed your order, we do everything we can to ensure that you receive what you have ordered on the desired day. We aim to process your order on the first working day after you have received your order confirmation from us. For more information, see section 5 Delivery.
The goods shown at www.pafyll.com must be in stock, but we must still make reservations that errors may occur and a product may be out of stock. If we fail to deliver according to your order, we will cancel the order and you will get your money back. You will be notified of this by email.
4. Payment
It should be easy to be a customer of På(fyll). In the pilot phase, payment takes place in our online store via Vipps and in the long term we also plan to offer other payment solutions. Quick and easy payment with Vipps is transferred via NETS and you only need to follow the instructions in the Vipps app. The amount is reserved when the order is confirmed and the money is deducted once the order is shipped. This requires a smartphone with a Vipps app and user account. Payment via Vipps follows their terms of use. Here you will find the Vipps privacy policy.. 5. Delivery and Return
Delivery options, prices and delivery time
In the first phase of the launch, HeltHjem Netthandel AS will transport all our deliveries to your home. Helthjem delivers to mainland Norway 6 days a week, and in some areas also on Sundays. All shipments with HeltHjem Netthandel have tracking, so you can follow the package from us all the way to your home. Read more about Helthjem here: https://helthjem.no/.
Delivery
In most cases, Helthjem will deliver your refill to your home by newspaper courier at night, and you therefore do not need to personally receive or sign for the package. The package is placed safely on the doormat or in your mailbox, and we will send you an SMS when the package is delivered, so you can take in the package when you get up in the morning.
Return
When your På(fyll) container is empty, you can order a return while also ordering a refill. The new containers are delivered before you return the empty ones. It's also possible to order a return only at pafyll.com/return or by scanning the QR code on the container.
Pack the empty containers in the cardboard box you received your refill in, if you ordered this, or any other suitable cardboard box you have at home. Attach the return label to the box before placing it at the designated time on the same location where you received your Helthjem delivery.
Ownership, Use and Replacement of Containers
The ownership of the containers remains with Påfyllsystemer AS. These containers are loaned to customers for the purpose of storing the products (consumables). Failure to return containers within 6 months from the date of purchase will incur the customer's responsibility to replace them.
Our containers are offered as part of our circular value chain, with the goal of reducing the environmental impact by limiting the production of unnecessary plastic waste/containers, as well as to ensure material recycling of damaged containers.
The replacement cost of a missing or unreturned container will be charged according to market value, and the specific cost will vary depending on the type and size of the container.
6. Right of withdrawal
You are protected by the Right of Withdrawal Act and have a 14-day unconditional right of withdrawal from the day you receive the item. The right of withdrawal means that you have the right to cancel the purchase for the unopened product and return the item and get the purchase price back. In order for the right of withdrawal to be enforced, the product must be returned to us in the same quantity and condition as you received it. If the value of the item is reduced more than necessary to determine the nature, properties and function of the item, you must cover this loss of value.
Along with the confirmation email, we sent you a standard withdrawal form, this is also available here, and if you wish to cancel the purchase, we ask you to send us this form or otherwise clearly inform us that you wish to cancel. Feel free to contact us at help@pafyll.com, we are happy to help.
7. Open purchase
If you have shopped at På(fyll), we are not satisfied until you are satisfied. If there is anything you are not satisfied with in the service, you have in addition to the right of withdrawal 14 days of open purchase from the order date. If so, please contact us at hello@pafyll.com, and we will find a good solution, but note that the product must be worn out.
8. Complaints and claims
We guarantee that the products you have ordered are free from defects and damage when you receive them. If you nevertheless receive a product where there is a defect in the item, you must contact us at help@pafyll.com within a reasonable time.
By reasonable time we mean within 2 months from when the defect was discovered or should have been discovered. Complaints can be made no later than two years after you took over the item. If the product or parts of it are intended to last significantly longer than two years, the warranty period is five years.
På(fyll) covers the return cost of complaints and incorrect deliveries. All complaints are checked and approved by us. In case of complaints, the selling price for advertised goods / s as well as shipping cost will normally be credited to your account within 5-10 working days.
9. Security
We use secure pages for the transmission of sensitive information such as card information and personal information. You can verify that the website you are visiting is secure yourself by looking at the URL. Common URLs begin with http://, but if you're on a secure page, it starts with https://, where the "s" stands for "secure."
10. Force majeure
In the event of force majeure, Påfyllsystemer AS is exempt from penalties for failure to perform certain obligations under this agreement. If the situation lasts longer than two months, both Påfyllsystemer AS and the customer have the right to cancel the purchase. Force majeure means, among other things, natural disasters, floods, fire, conflict, war, sabotage, strikes, illness, accident, transport delays, import / export ban, embargo, new or changed legislation and other circumstances beyond Påfyllsystemer AS's control, regardless of whether it occurs at Påfyllsystemer AS or at one of our suppliers or partners.
Force Majeure also applies in labour disputes and blockades where Påfyllsystemer AS itself is the subject of or initiates such an action. Påfyllsystemer AS is not guilty of compensating damage in other cases where normal care has been shown.
Force Majeure also includes administrative decisions that adversely affect the market and products, such as prohibitions, abnormal market declines or the company being subjected to criminal acts that affect operations.
11. Disputes
Attempts shall be made to resolve any disagreements and disputes amicably. If this does not succeed, the buyer can contact the Consumer Authority for mediation. The Consumer Authority is available by telephone 23 400 600 or www.forbrukertilsynet.no.
Disputes regarding these terms and conditions shall be settled in accordance with Norwegian law, and may be brought before Oslo District Court.
